“20 YEARS OF HELL” COMPETITION TERMS AND CONDITIONS OF PARTICIPATION

(hereinafter referred to as “Game Rules“)
PLEASE READ THE GAME RULES CAREFULLY AND PARTICIPATE IN THE GAME ONLY IF YOU AGREE TO THE TERMS AND CONDITIONS SET OUT HEREIN AND ARE OVER THE AGE OF 18 YEARS.
1. The organiser of the Game
1.1. “20 YEARS OF HELL” Competition (hereinafter referred to as the “Game“) is organised by HELL ENERGY Magyarország Kft. (registered office: H-1062 Budapest, Andrássy út 126; company registration number: 01-09-729429; tax number: 13324223-4-44; contact: info@hellenergy.hu; hereinafter referred to as the “Organiser“).
1.2. The implementation of the Game is carried out by the Organiser within its own organisation.
2. Conditions of participation
2.1. The Game is open only to natural persons over the age of 18 years, who are not among the persons defined in Section 2.5 and who are capable of acting (hereinafter referred to as “Player“), who during the period of time specified in Section 3 of the Game Rules
2.1.1. presents one (1) HELL product at the venue of the Game to the Organiser or to the on-site staff designated by it, which is accepted by the on-site staff as suitable for participation in the Game,
2.1.2. credibly proves his/her age to the on-site staff, during which the on-site staff is entitled solely to verify whether the Player has reached the age of 18; the Organiser shall not make a copy of the document presented by the Player during the age verification and shall not record any data learned therefrom,
2.1.3. receives a unique code (hereinafter referred to as the “Code”) from the on-site staff on the basis of the presented and accepted HELL product,
2.1.4. uses the received Code at the venue of the Game, in accordance with Section 4 of these Game Rules, during the designated safe game, by which use he/she simultaneously accepts all the conditions set out in these Game Rules, and
2.1.5. acknowledges that if the Code does not open the safe, he/she shall be entitled to the Guaranteed Gift defined in Section 4.3, subject to stock availability, in accordance with these Game Rules.
2.1.6. If the Player is a person over the age of 18 with limited legal capacity, he/she is entitled to claim the prizes listed in Sections 4.2 and 4.3 of these Game Rules only together with his/her legal representative, upon proof of identity of the legal representative.
2.1.7. If the Player is an incapacitated person over the age of 18, only his/her legal representative may act on his/her behalf, upon proof of identity of the legal representative.
2.2. Participation in the Game may be granted by any previously purchased, identifiable HELL product, provided that its acceptance is decided by the on-site staff. One presented and by the on-site staff accepted HELL product entitles the Player to receive one Code and thus to one on-site game opportunity.
2.3. The Code cannot be edited or otherwise modified afterwards and may only be used once. One Player may participate in the Game only once and is entitled to receive only one (1) Code. The Organiser reserves the right to exclude the Player from the Game if it detects or reasonably suspects that the Player intends to participate in the Game more than once or seeks to violate the conditions of participation in any way.
2.4. Participation in the Game is not subject to registration, and the Players do not provide personal data to the Organiser in advance. During participation in the Game, the Player is obliged to prove, at the request of the on-site staff, the fulfilment of the conditions set out in these Game Rules – in particular that he/she has reached the age of 18. The Player is furthermore obliged to provide the Organiser with the true and accurate data necessary for the delivery of the prize exclusively in the event that he/she becomes a winner in the Game. The Organiser shall not be liable for any consequences arising from any changes in or inaccuracies of the data that are beyond the Organiser’s control.
2.5. The employees of the Organiser and its affiliated companies, and the close relatives of these employees pursuant to point 1. of paragraph (1) in section 8:1 of Act V of 2013 on the Civil Code (hereinafter: “Civil Code“) are excluded from the Game, as well as other direct contributors to the conduct of the Game and their close relatives.
2.6. The Organiser shall automatically exclude from the Game any Player who participates under false circumstances by circumventing the conditions of the Game Rules. The Organiser will only consider valid those participations where the Player participates in the on-site Game using a Code based on a HELL product presented by himself/herself and accepted by the on-site staff, and the Code is original and free from external interference. The Organiser excludes all liability in relation to disputes arising from the authenticity of the Code or the existence of eligibility for participation.
2.7. By using the Code, the Player acknowledges that the content, performance, message and data transmission and response speed of the technical infrastructure of the Game are dependent on the server technology and may be adversely affected by factors beyond the control of the Organiser, such as (but not limited to) connection failure, server computer performance, network congestion, network load, coverage, the operation of the on-site electronic system and the maintenance of a secure network connection. The Organiser excludes all liability arising from this paragraph.
2.8. The use of the Code may be examined by the Organiser for compliance with the terms and conditions of the Game Rules, and if the Code or the Player using it does not comply with the terms and conditions of the Game Rules for any reason, the Player concerned may be disqualified from the Game.
2.9. Players who, contrary to the spirit of the Game, participate in the Game in a deceptive or abusive manner, with the aim of increasing their chances of winning by deceptive conduct, may be excluded from the Game at the sole and unbiased discretion of the Organiser. Such Players include in particular those who intend to participate in the Game under unreal circumstances, in place of another person or by any other unfair means. Players who engage in the unfair conduct set out in this clause shall be liable to compensate the Organiser for any damage caused to it in connection with the Game.
2.10. The on-site staff designated by the Organiser is entitled to verify the age-related conditions of participation in the Game. During this process, the Player is obliged, at the request of the on-site staff, to credibly prove that he/she has reached the age of 18 required for participation in the Game. For this purpose, the on-site staff may request the presentation of a valid official identity document suitable for personal identification. A person who does not prove on-site that he/she has reached the age of 18 may not participate in the Game. The personal data contained in the presented document shall not be recorded or copied by the Organiser or the on-site staff and shall be viewed exclusively for the purpose of on-site verification of eligibility.
3. Duration of the Game and Products Participating in the Game
3.1. The Game shall last from 16:00 on 24th April 2026 until 19:00 at the latest (hereinafter referred to as the “Game Period“). The venue of the Game is: Trgu Josipa Jurja Strossmayera, Zagreb.
3.2. Only identifiable HELL products accepted by the on-site staff shall participate in the Game (hereinafter referred to as the “Products Participating in the Game“).
3.3. The Organiser is entitled to interpret the scope of the Products Participating in the Game and to decide whether the presented product qualifies as suitable for participation in the Game.
4. Procedure of the Game and the prizes
4.1. Tasks of the Players:
During the Game Period, the Player shall present one (1) of the Products Participating in the Game at the venue to the designated on-site staff. Following the verification of the presented product and proof that the Player has reached the age of 18, the on-site staff shall hand over one (1) Code to the Player.
Following receipt of the Code, the Player may enter the designated game area and, in accordance with the instructions of the on-site staff and the queueing order, may enter the Code on the display surface of the safe placed on-site or on the related electronic interface.
During the Game, only the Player who uses at least one (1) valid Code handed over in accordance with these Game Rules may participate in the on-site game. During the Game, each Code may only be used once. Codes used outside the Game Period shall not be taken into consideration.
If the Player enters the Winning Code, the safe shall open and the Game shall immediately end, and the Winning Player shall become entitled to the Grand Prizes defined in Section 4.2 of these Game Rules.
The Player whose Code does not open the safe shall be entitled to the Guaranteed Gift defined in Section 4.3, subject to stock availability.
4.2. Grand Prizes: the grand prizes of the Game are the following prizes (hereinafter collectively referred to as the “Grand Prizes“), which may be claimed by one single winning Player (hereinafter referred to as the “Grand Winner“):
1. EUR 10,000 (that is: ten thousand Euros) gift card,
2. 1 (one) pallet (that is: a total of 2,880 pieces) of HELL CLASSIC 250 ml product,
3. 5 (five) HELL Fight tracksuits in the colour and size chosen by the Grand Winner.
The delivery and fulfilment of the Grand Prizes shall take place in accordance with Section 6 of these Game Rules.
4.3. Guaranteed Gift: those Players whose Code does not open the safe shall be entitled, as a guaranteed gift – subject to stock availability – to 1 (one) HELL 4-pack package (hereinafter referred to as the “Guaranteed Gift“).
4.3.1. The Guaranteed Gift shall be granted to the Player on one occasion, meaning that for each validly used, non-winning Code, one (1) HELL 4-pack package may be handed over.
4.3.2. The Player is not entitled to choose the type or characteristics of the Guaranteed Gift.
4.4. The Guaranteed Gift and the Grand Prizes (hereinafter collectively referred to as the “Prizes“) are non-transferable and, unless otherwise provided for in these Game Rules, are not redeemable for cash. The Guaranteed Gift shall be handed over subject to stock availability. If the stock runs out at the venue, the Organiser shall not be obliged to provide further packages and shall not accept any claims arising therefrom.
4.5. The unique code contained in the HELL 4-pack package may be uploaded to the website winwithhell.hr where the rules of participation of the competition called HELL 4-pack Promotion may also be viewed.
4.6. The Organiser excludes its liability for any defects or deficiencies in the Prizes and shall not be liable for any warranty or guarantee in respect of the Prizes, unless the exclusion of liability is expressly prohibited by Hungarian law.
5. Winning mechanism
5.1. The on-site Game does not operate by draw, but on the basis of a pre-determined winning mechanism. For the entire duration of the Game, the Organiser shall determine one (1) winning Code (hereinafter referred to as the “Winning Code”) before the start of the Game, by the correct use of which the safe shall open.
5.2. During the Game, each Code handed over and used on the display surface of the safe or on the related electronic interface in accordance with these Game Rules shall qualify as one (1) independent game opportunity.
5.3. The Player who uses the Code handed over to him/her during the Game and which proves to be the Winning Code, as a result of which the safe opens, shall become entitled to the Grand Prize.
5.4. The handover of the Code in itself does not create entitlement to winning; winning depends exclusively on whether the Code handed over to the Player is the Winning Code and whether the Player uses it properly in accordance with these Game Rules.
5.5. The Winning Code shall be determined by the Organiser before the start of the Game, in a closed system, following the principle of randomness. The Organiser is entitled to prepare minutes or internal records regarding the determination of the Winning Code.
5.6. During the on-site Game, one (1) Grand Winner shall be determined. No reserve winner shall be determined.
5.7. Every Player whose Code is used but the safe does not open during the given game opportunity shall be entitled to the Guaranteed Gift, provided that his/her participation in the Game complies with these Game Rules.
5.8. If the Winning Code is not used during the Game Period, or if entitlement to the Grand Prize cannot be established for any reason, the Organiser shall be entitled to decide separately on the further fate of the Grand Prize.
6. Notification of winners, delivery of prizes
6.1. The Grand Winner shall be informed at the venue of the Game, upon the occurrence of the winning event, that – subject to compliance with the provisions of these Game Rules – he/she has become entitled to the Grand Prize (hereinafter referred to as the “Notification”).
6.2. Eligibility for the Grand Prize requires that the Grand Winner properly proves, on-site or at a later date determined by the Organiser, his/her identity, age and – if necessary for the delivery of the Prize – the delivery details provided by him/her, and furthermore cooperates as necessary for the handover of the Grand Prize.
6.3. The Guaranteed Gift shall be handed over to the Player on-site – subject to stock availability – after entering the Code, if the safe does not open.
6.4. The cash amount of the Grand Prize shall be transferred by the Organiser to the bank account number provided by the Grand Winner on-site within 90 (ninety) calendar days following the Notification.
6.5. The tangible parts of the Grand Prize, in particular the 1 pallet of HELL CLASSIC 250 ml product and the 5 pieces of HELL Fight tracksuit, shall be delivered by the Organiser to the Grand Winner within 90 (ninety) calendar days following the Notification. The HELL Fight tracksuits shall be provided in the size and colour specified by the Grand Winner, subject to available stock.
6.6. The Prizes shall be delivered / handed over exclusively to an address in Croatia. The Organiser does not undertake delivery of the Prizes to a foreign address.
6.7. The Organiser shall not accept any liability whatsoever for any deficiency or error in the delivery details provided by the Player (e.g. misspelling of name, misspelling of address, incorrect bank account number, etc.), for any failure or delay in delivery or transfer for such reason, or for any damage incurred during delivery/shipping.
6.8. The winning Player shall cooperate in order to ensure that the Prize is delivered no later than 90 (ninety) days following the end of the Game Period. If the Grand Winner fails to comply with this obligation to cooperate, and thus the timely delivery of the Prize is prevented, this circumstance shall not be assessed against the Organiser. The Organiser shall be able to provide the possibility of claiming the Prize within this deadline, exclusively at a delivery/collection address in Croatia.
6.9. The Organiser shall exclude from the Game any Player to whom the Prize cannot be delivered because the personal data provided by him/her for the delivery of the Prize are not true, incomplete or incorrect, or the Player does not meet the personal requirements described in these Game Rules for any other reason. The Organiser shall not be liable in any way whatsoever as a result of the incorrect information provided by the Player.
7. Taxation, costs
7.1. The Organiser shall bear any personal income tax (SZJA) payment obligation related to the Prizes. The Organiser shall have no further obligations other than the delivery of the Prizes as described above and the settlement of their tax implications.
8. Data protection, personal rights
8.1. Data processing in connection with the Game shall be carried out in accordance with the terms and conditions set out in the Organiser’s privacy notice entitled “Privacy Notice for the competition called ‘20 YEARS OF HELL’”.
9. Miscellaneous provisions
9.1. The Organiser shall not accept any liability whatsoever for any deficiency/error in the use of the Code or in participation (e.g. mistyping the code, etc.), for any failure or delay in the delivery of the Prize which is beyond the Organiser’s control, or for any damage caused during delivery.
9.2. The Organiser excludes all liability for any external, unauthorised intervention or attack affecting the electronic system, display surface, server or related technical solution used at the venue of the Game. Accordingly, in the event that, as a result of such event, the Players receive incorrect system messages regarding their prizes, winner/non-winner status or other circumstances, the Organiser shall not be liable in any way for such cases.
9.3. The Organiser reserves the right to exclude any Player from the Game with immediate effect if it detects or has reasonable grounds to suspect any (computer) manipulation or any conduct incompatible with or in any way offensive to the spirit of the Game.
9.4. The Organiser excludes any liability for any malfunction of the technical system used for the implementation of the Game for reasons beyond its control, during which the Game may be unavailable or of limited use, but shall take all necessary steps without delay to investigate and eliminate the cause of the malfunction as soon as possible.
9.5. The Organiser reserves the right to modify the conditions of the Game without giving any reason, including the termination of the Game. The Organiser will publish the relevant information with the same publicity as other announcements in the Game. After the modification, the Players may fully exercise their rights acquired up to the date of the modification. Before participating in the Game, please read these Game Rules carefully in all cases, in particular any amendments, so that you are always aware of the conditions of the Game. Participation in the Game is voluntary. The limitations and exclusions of liability in relation to the Game shall apply to the extent permitted by applicable law.
9.6. The Organiser shall not be held liable for any misadvertisement of the Game if it is made without its approval and for reasons beyond its control.
9.7. These Game Rules shall be governed by Hungarian law and any disputes arising in connection with participation in the Game shall be subject to the exclusive jurisdiction of the Hungarian courts.
9.8. If any provision of these Game Rules is invalid, illegal or unenforceable under Hungarian law, all other provisions of these Game Rules shall remain in full force and effect and the invalid, illegal or unenforceable provision of these Game Rules (as long as it remains invalid, illegal or unenforceable) shall be severed from these Game Rules. The Player and the Organiser shall use all reasonable efforts to replace the provision that is deemed invalid, illegal or unenforceable (severed) with a valid, legal and enforceable provision that has the legal effect of the intended legal effect of the severed provision to the maximum extent possible.
